Nach § 146a der Abgabenordnung (AO) müssen bestimmte elektronische Aufzeichnungssysteme (insbesondere elektronische Kassensysteme und Registrierkassen) ab dem 1.1.2020 über eine zertifizierte technische Sicherheitseinrichtung (TSE) verfügen. Erst kürzlich wurden die Anforderungen in einem Anwendungserlass der Finanzverwaltung näher präzisiert. Der Deutsche Industrie- und Handelskammertag (DIHK) hat nun berichtet, dass das Bundesfinanzministerium eine Nichtaufgriffsregelung bis zum 30.9.2020 anvisiert.
Nach den DIHK-Informationen sind zurzeit noch keine zertifizierten Sicherheitslösungen am Markt erhältlich. Voraussichtlich erst im Oktober 2019 sollen die ersten – vorläufig zertifizierten – TSEs verfügbar sein, sodass keine flächendeckende Ausstattung aller Kassen bis zum 1.1.2020 möglich ist. Daher plant das Bundesfinanzministerium, so der DIHK, ein Schreiben mit einer Nichtaufgriffsregelung bis zum 30.9.2020. Das Schreiben soll nach Abstimmung mit den Ländern Ende September/Anfang Oktober 2019 veröffentlicht werden.
